In Pennsylvania, a person can be convicted of driving under the influence if he or she drives, operates or is in physical control of a vehicle after drinking any amount of alcohol which makes him or her incapable of safely driving a motor vehicle.
Alternatively, a person can also be convicted of DUI for driving, operating or being in physical control of the movement of a vehicle while having a blood alcohol content of .08 percent or higher within two hours of driving that car or other motor vehicle.
