In Pennsylvania, insured drivers must choose between full tort insurance coverage and limited tort insurance coverage.
Although a driver can save a small amount of money upfront by choosing “limited tort” coverage, this restricts the driver from recovering for pain and suffering which they experience in an accident caused by the fault of another driver. Although “full tort” coverage does cost more, drivers who choose this policy are not restricted from recovering for pain and suffering.
Depending on the type of injuries, the amount owed for pain and suffering can often be very substantial. There is an exception to this rule, which does permit an individual who has chosen “limited tort” to recover for pain and suffering if they received a “serious injury.” However, this term, by law, is limited to circumstances involving death, serious and permanent disfigurement, or injuries which result in serious impairment of bodily functions.
