Discovery Tactics: the Good, the Bad, and the Outrageous

On Tuesday, September 19, 2017, Attorney J.T. Herber, III presented a Continuing Legal Education (CLE) class in Philadelphia.  The course was entitled “Discovery Tactics: the Good, the Bad, and the Outrageous” and was held at the Pennsylvania Bar Institute’s (PBI) Philadelphia Conference Facility.  The Pennsylvania Bar Institute is the educational division of the Pennsylvania Bar Association.

The program focused on ways to professionally address improper/unfair discovery methods, and practical advice on how to respond to such issues.

Attorney Herber’s portion of the program focused on preparing and filing motions relating to such tactics, including the filing of Motions to Compel Discovery, as well as Motions for Sanctions.

Approximately 20 attorneys were present for the program in Philadelphia, and dozens more watched the proceeding as it was simulcast at various locations throughout the state.  Participants received a total of 3 credit hours for the program, including 2 substantive credits and 1 ethics credit.

This is the third continuing legal education program which Attorney Herber has taught with the Pennsylvania Bar Institute since 2015.  This program was co-presented by Attorneys Brian W. Waerig and Mariellen Bello of Susanin, Widman, and Brennan, P.C. of Wayne, Pennsylvania, as well as Attorney Wesley R. Paine, IV of White and Williams, LLP based out of Philadelphia.

In addition to presenting the CLE programs, Attorney Herber also co-authored a CLE “yellowbook” on the same topic through PBI, which is now in its second printing.
